The Privacy Policy of the Société des Droits Voisins de la Presse (DVP) aims to provide you with clear and transparent information on how your personal data is processed, depending on the nature of your relationship with DVP (as an applicant, member, online communication service, etc.). This Privacy Policy also informs you of your rights under applicable regulations and how you can exercise them with DVP.

1.Protection of Personal Data

A personal data item is information that allows you to be identified as a natural person, either directly (e.g., your first and last name) or indirectly, in particular through an identifier (e.g., IP address).

As data controller, DVP places particular importance on the protection of your personal data. DVP undertakes to comply with the applicable legislation, in particular the General Data Protection Regulation of April 27, 2016 (“GDPR”), effective since May 25, 2018, and the amended French Data Protection Act of January 6, 1978 (“Loi Informatique et Libertés”).

The Société des Auteurs, Compositeurs et Éditeurs de Musique (SACEM) and the Centre Français d’Exploitation du Droit de Copie (CFC) process personal data on behalf of DVP, as its processors.

DVP has appointed a Data Protection Officer (DPO), whose contact details are as follows:

Under applicable regulations, any personal data made accessible on DVP’s website may not be collected or processed without the prior written consent of the data subject. In particular, it is strictly prohibited to collect or use such data, manually or automatically, notably for the purpose of sending unsolicited advertising messages.

1.1 How does DVP process the personal data you provide?

Depending on your relationship with DVP, we process your data as follows:

If you are an applicant or a member of DVP:

1) For press publishers

• Identification data of the press publisher who is a natural person: last name, first name, customary/married name, nationality, date of birth, place of birth, country of birth, email address, phone number.
• Data concerning the legal representative(s) of the press publisher that is a legal entity, including: position (President/Chair/CEO, Director, Manager, Administrator, or other), last name, first name, nationality, date of birth, place of birth, country of birth.
• A photocopy of an identity document of the press publisher (natural person) or of the legal representative(s) of the press publisher (legal entity).
• Data relating to publications: publication title, URL, and CPPAP number where applicable.
• Financial data: amount of royalties, royalty statements, bank details (RIB/IBAN).
• Original Kbis extract (company registration certificate) and company bylaws.

2) For news agencies

• Data concerning the legal representative(s), including: position (CEO/PDG, Director, Manager, Administrator, or other), last name, first name, nationality, date of birth, place of birth, country of birth.
• A photocopy of an identity document of the legal representative(s) of the news agency.
• Data relating to publications: publication title, URL, and CPPAP number where applicable.
• Financial data: amount of royalties, royalty statements, bank details (RIB/IBAN).
• Original Kbis extract (company registration certificate) and company bylaws.

• Managing your membership application to DVP.
• Monitoring and managing your status as a DVP member, including handling complaints and claims.
• Managing documentation.
• Managing contributions made by press publishers and news agencies.
• Managing the addition, by publishers, of press publications.
• Managing the addition, by press publishers and news agencies, of one or more territories to the contribution made to DVP.
• Processing requests to withdraw contributions of publications and/or online public communication services and/or territories.
• Managing the collection and distribution among members of neighbouring rights owed, for DVP’s repertoire, by online public communication services.
• Bringing legal actions to defend your economic, material, and moral interests as a DVP member.

• Based on the membership instrument you signed to become a DVP member.
• Based on provisions of the French Intellectual Property Code (Code de la propriété intellectuelle – CPI).
• Pursuant to DVP’s Articles of Association and General Rules.
• Based on DVP’s legitimate interest in communicating with you.

• DVP’s internal departments.
• Other collective management organisations with which DVP has a service agreement, in particular SACEM and CFC.
• Social security, tax, and financial bodies.
• Other collective management organisations with which DVP has concluded representation agreements.

For the duration of your DVP membership, then for the applicable statutory limitation periods to which DVP is subject in the course of its activities.

If you are an online public communication service:

• Managing your authorisation requests.
• Collecting neighbouring-rights royalties and handling the follow-up on authorisations, invoicing, accounting, and recovery.
• Sending you newsletters and other communications.
• Monitoring whether DVP repertoire publications are used.

• Based on authorisation agreements.
• Based on provisions of the French Intellectual Property Code (CPI).
• Pursuant to DVP’s Articles of Association and General Rules.
• Based on DVP’s legitimate interest in communicating with you.

• DVP’s internal departments.
• Other collective management organisations with which DVP has a service agreement, in particular SACEM and CFC.

• For the entire duration of the contractual relationship, then for 5 years after its termination, subject to longer statutory limitation periods in case of disputes.
• Accounting data are retained for no longer than 10 years from the end of the fiscal year to which they relate.
• For the duration of your subscription to DVP newsletters.

If you submit a request for information, your data is processed and used by DVP in its legitimate interest of communicating with you regarding your request. It is retained for the time required to process your request, and then for the statutory limitation periods in case of a dispute.

You have the right to access, delete, rectify, object to, or restrict the processing of your data. You may exercise these rights:

1.2 What are your rights?

  • Under data protection regulations, you have the following rights:
  • Right to information: to obtain additional details on how DVP processes your data.
  • Right of access: to view and verify your data.
  • Right to rectification: to amend and/or complete your data.
  • Right to erasure: to request deletion of inaccurate or outdated data.
  • Right to restriction of processing: to temporarily freeze the use of certain data while DVP reviews your rectification or objection requests.
  • Right to object: to object to processing based on your particular situation.
  • Right to withdraw consent: to withdraw your consent at any time, where consent is the legal basis for processing.
  • Right to data portability: to receive the personal data you have provided to DVP in a structured, commonly used, machine-readable, and interoperable format, and to transmit it to another controller.

 

Additionally, under the amended French Data Protection Act of January 6, 1978, you may define specific instructions regarding the handling of your personal data after your death.

DVP may request additional information to confirm your identity, including proof of ID, to avoid any risk of mistaken identity. This copy will be deleted once your request has been processed. If your request is manifestly unfounded or excessive, DVP may charge reasonable fees or refuse to process it (e.g., due to its repetitive nature).

If, despite reminders, you receive no response from DVP, you may contact the DPO (Mélanie Loubersac – Société des Droits Voisins de la Presse – 2 rue du Général Lanrezac, 92200 Neuilly-sur-Seine) or file a complaint with the Commission Nationale de l’Informatique et des Libertés (CNIL).

1.3 How does DVP secure your data?

DVP, as controller, and SACEM and CFC, as processors, ensure the protection of your personal data by implementing appropriate technical and organizational measures to guarantee a level of security appropriate to the risks.

2. Cookies
